A central pillar of the procurement process is transparency.

In order to ensure the process is fair to all interested parties, from tendering companies, stakeholders and the general public, the process must be open and transparent, and decisions must be communicated with sufficient reasons to support the decision.

This afternoon seminar will look at the obligations on contracting authorities, what they must record and what information they must provide in a tender process.  We will investigate the potential pitfalls and suggest tactics to avoid challenges.

Topics covered

We will address questions like:

  • What information must be provided to bidders?
  • What can bidders ask for?
  • How to protect commercially sensitive information
  • How to give reasons and debrief bidders:
    • Writing the perfect Dear John letters
    • How much information do I need to give?
    • How to handle debrief meetings
    • Dealing with aggrieved bidders and heading off challenges

We will be looking at some recent case law and how this adds to the rules in the Regulations.
